These General Terms and Conditions of Sale apply to sales concluded between, on the one hand, any adult individual residing in France or abroad who makes a purchase via the online sales website www.manmori.com and, on the other hand, MANMORI Bernard Saligné.
As such, they apply automatically to all orders placed on the website www.manmori.com, which is the exclusive property of Bernard Saligné and whose publication director is Bernard Saligné, an independent entrepreneur.

The products offered on the website www.manmori.com are governed by these terms and conditions of sale; they are valid as long as they remain online and while stocks last.
The products offered for sale on the website www.manmori.com are described as accurately as possible. The photos, texts, and drawings associated with the products presented are for illustrative purposes only and are not contractual; minor differences may sometimes exist.
ARTICLE 3. Orders.
Any order placed on the website www.manmori.com implies express acceptance of these General Terms and Conditions of Sale and acceptance of the prices and products available for sale.
Ordering process:
Customers wishing to place an order must follow the procedure below:
Product selection: you must select the product you wish to order;
Checking the contents of your selection: you check the contents of your basket, retaining the option to remove any products you have selected;
Identification: you must complete the identification form provided and enter the requested information (mandatory information: title, surname, first name, address, email address, password, telephone number for delivery);
Verify your order: you check the contents of your order, the total price, the delivery and billing addresses, while retaining the option to remove a product or change the billing and delivery address + you choose your payment method + you must confirm your acceptance of these general terms and conditions of sale by ticking the corresponding box. The order can only be confirmed after this box has been checked;
Several payment options are available: PayPal (accessible by credit card even without an account), Stripe with secure payment (SSL), and bank transfer.
Order confirmation: you will receive an email summarizing the contents of your order, including:
– your order number;
– the bank transaction number;
– the list of products ordered;
– the delivery terms.
We advise you to keep and print this document, which is the official proof of your order. Your order is then registered and processed by our sales department, which checks the availability of the product(s) ordered. Any order placed implies acceptance of the prices and descriptions of the products available for sale. MANMORI undertakes to fulfill orders received on its website only while stocks last.
If the products ordered are unavailable, MANMORI will contact you by phone or email as soon as possible to agree with you on how to proceed with your order:
– shipment of the available product(s) within a new approximate delivery time, or
– cancel and refund the order.
In the event of a reduction or cancellation of an order (due to the unavailability of the product(s)), the amount of your bank transaction will be modified or canceled accordingly to correspond to the items finally ordered.Confirmation of order dispatch: you will receive an email summarizing the contents of your order and confirming that your order has been dispatched. The contract is deemed to have been concluded on the date this email is sent.

If you would like information about the status of your order, please refer to your Manmori customer account in the “My Account/Order” section of the website www.manmori.com. You will also receive information by email about the various stages of the order processing and preparation process until it is shipped.
ARTICLE 4. Prices and payment terms
The prices charged are those in effect on the day of the order. All our prices are net (VAT exempt, art. 293b of the French General Tax Code) excluding delivery costs. Delivery costs will be indicated in the “shopping cart” when the order is confirmed.
MANMORI reserves the right to modify its prices at any time, but products are invoiced on the basis of the prices in effect at the time the order is confirmed by the customer.
Delivery costs are shown when you view your basket.
Payment methods:
By credit card (Visa, CB, Mastercard): in this case, payment is made via STRIPE, PAYPAL, or bank transfer. This means that none of your banking information is transmitted via the www.manmori.com website.
Payment by credit card is secure (SSL). Your order will be registered and confirmed as soon as payment is accepted by the banking service.
Security:
Your credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank. MANMORI has no access to this information and does not store it on its servers.
Retention of title clause:
The products remain the property of MANMORI until full payment has been received by MANMORI. However, upon delivery, the risks associated with the delivered goods are transferred to the customer.
Default of payment:
MANMORI reserves the right to refuse to make a delivery or to honor an order from a consumer with whom a payment dispute is ongoing.
ARTICLE 5. Delivery terms and conditions
General information:
Products purchased on www.manmori.com are delivered only in France and internationally. Products are delivered to the delivery address you provided during the ordering process. The delivery times indicated are average times and correspond to the time required for production, processing, preparation, and shipping of your order.
Delivery time:
For all products in stock, the order is prepared for shipment from our warehouses within a maximum of 72 hours (subject to stock availability) from the email confirmation of your order. Delivery is then made by carrier within an approximate average time of 3 to 4 business days. The average time between an order and its delivery is 6 business days.
This is an average time depending on the destination and availability of the product ordered. Exceeding this time limit shall not give rise to any cancellation of the order, any reduction in the price paid by the buyer, or any payment of damages.
Due to the specific nature of MANMORI products, particularly “custom-made” products, MANMORI will confirm the delivery time for each order. However, in accordance with the provisions of Article L.121-20-3 of the Consumer Code, if delivery has not been made within thirty days of the day after you placed your order, you will be able to cancel your order at no cost. Any sums you have paid will then be refunded to you.
Where possible, MANMORI reserves the right to offer you a product of equivalent quality and price to the original product.
Delivery and complaints:
All packages are shipped via Colissimo (for items no longer than 135 cm) and UPS or FedEx for larger items.
Delivery is made to the delivery address specified by the customer during the ordering process. If the recipient is absent at the time of delivery, the delivery driver will leave a delivery notice in the recipient’s mailbox. The recipient must then collect the package from the address specified on the delivery notice (or post office).
A delivery note is enclosed with your package. We advise you to keep it, as it will serve as proof of delivery.
You must check the conformity of the goods delivered at the time of delivery and before signing the carrier’s delivery note. You must indicate on this delivery note, in the form of handwritten reservations accompanied by your signature, any anomaly concerning the delivery (damaged product, etc.). This verification is considered to have been carried out once you, or a person of your choice, have signed the delivery note. No claims regarding the condition of the delivered package(s) will then be accepted.
If you have any reservations, you must also confirm these reservations to the carrier by registered mail no later than three business days after receiving the item(s) and send a copy of this letter to MANMORI.
In the event of an incomplete address, incorrect address, refusal of the package by the recipient, or lack of information resulting in the inability to deliver the product to the recipient on time, MANMORI cannot be held responsible for the final quality of this delivery. If this lack of information results in a second delivery attempt to the recipient, MANMORI will be entitled to charge you for the costs associated with this second delivery.
In the event of the recipient’s absence, MANMORI cannot be held responsible for the final quality of the delivery.
Any complaints regarding the delivery of products must be made within 7 working days of the delivery date. Products must be returned in their original condition (packaging, accessories, etc.) to the address indicated in Article 10.

ARTICLE 6. Right of withdrawal
According to Article L.121-20-1 of the Consumer Code, the buyer may request a refund of all sums paid in connection with their order within 7 days. If the item being returned is not defective, this refund does not include return shipping costs, as these do not constitute sums paid when the order was placed.
Prior to any return, the customer must indicate their intention to exercise their right of withdrawal to MANMORI in accordance with the following terms and conditions:
– The customer shall contact MANMORI by email at contact@manmori.com or by post at the address given in Article 10. The return shall be made to this same address.
– This right of return can only be accepted for complete products in their original condition, accompanied by a copy of the purchase invoice (received by email when the order was confirmed) bearing the return number assigned by email by our Customer Service department and the delivery note (enclosed with the package upon delivery). Products returned incomplete, damaged, or soiled will not be accepted.
ARTICLE 7. Warranty and After-Sales Service
In accordance with Articles L211-4 et seq. of the Consumer Code and Articles 1641 to 1649 of the Civil Code, the seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. Thus, in accordance with the provisions of the Consumer Code, the item you have chosen is guaranteed against any manufacturing defect for a period of 2 years from the date of delivery. It also benefits from a warranty against hidden defects. These warranties do not cover misuse, wear and tear, or damage resulting from improper use of the product. If your product is defective or non-compliant, please return it to MANMORI. The invoice and the warranty certificate associated with the product will be required. After verification and in accordance with the provisions of Articles L211-9 and L211-10 of the Consumer Code, the defective item will be either repaired or replaced.

ARTICLE 8. Data protection provisions
The provision of personal information about you is essential for the processing and delivery of your orders. The ordering process on the www.manmori.com website requires the creation of a customer account in which your information is stored and protected by a password that you choose.
This information is strictly confidential and is intended for MANMORI exclusively for the purposes of processing your orders. It will be processed in strict compliance with the provisions of the French Data Protection Act of January 6, 1978.
You have the right to access, modify, rectify, and delete data concerning you at any time. To exercise this right, go to the “My Account” section, log in, and access your personal data to correct or modify it. You can also make a request to our web service by email: contact@manmori.com.
ARTICLE 9. Intellectual property
All documents, text information, graphics, images, photographs, or any other content published on the website www.manmori.com are the exclusive property of MANMORI and are reserved for MANMORI’s use. Consequently, they may not be reproduced, exploited, or used for any purpose whatsoever.

La responsabilité de MANMORI ne saurait être engagée pour tous événements, inconvénients ou dommages inhérents à l’utilisation du réseau Internet, notamment en cas de rupture du service, d’intrusion extérieure ou de présence de virus informatiques.
Par ailleurs MANMORI ne saurait être tenu pour responsable de l’inexécution du contrat conclu en cas de situation fortuite, de force majeure, de perturbation ou de grève totale ou partielle notamment des services postaux et moyens de transport et/ou communications, d’inondation, d’incendie. MANMORI n’encourra aucune responsabilité pour tous dommages indirects du fait des présentes, perte d’exploitation, perte de profit, dommages ou frais, qui pourraient survenir.

Manmori is a French company. The law applicable to our contractual relations is French law. In the event of a dispute, the French courts shall have jurisdiction.
